What To Expect In Your Divorce

The first step in a divorce is the initial filing phase when one partner files a Dissolution of Marriage (DOM) petition. The other spouse is then notified and served, and they have 20 days to respond to the petition. If they do not, the court can issue a default divorce ruling.

Some additional forms may be required, depending on the specifics of the relationship and the case. They include the Uniform Child Custody Jurisdiction and Enforcement Act Affidavit, the Child Support Guidelines Worksheet and the Certificate of Compliance with Mandatory Disclosure.

Financial disclosures also need to be made by each party regarding marital assets. They may need to file a Family Law Financial Affidavit. Marital assets have to be divided during divorce, while separate assets – those obtained prior to the marriage – do not. Some assets, like an inheritance, may be separate assets even when obtained during the marriage.

If necessary, temporary orders can be made, such as a temporary child custody order, so that the child maintains stability during the divorce process. The court always focuses on the child’s best interests. In domestic violence cases, emergency restraining orders may be used to protect spouses or children.

The parties then enter into the discovery phase, where assets are addressed, and begin negotiation over the terms of the divorce. They can carry out an asset and debt inventory, along with providing income verification. It is imperative that both parties be honest during this phase and report all the assets they own.

For child custody concerns, the parents can work on the development of a parenting plan. If they cannot agree on physical custody (where the child lives) or legal custody (making decisions for the child), the court must make a ruling.

The settlement discussions and negotiations, likewise, can often be resolved amicably. This may be done through mediation, which is required in most Florida counties or other methods of alternative dispute resolution (ADR). This keeps the decision-making power in the hands of the parents, as can be done during a collaborative divorce.

If the couple cannot agree on terms, though, they enter court litigation. The court considers all relevant factors and rules on how to divide assets or child custody rights. Court orders handed down at this time are binding, although it is possible to modify them in the future. It is crucial to take the proper legal steps.
